90-day rule for short-term rentals in Berlin


Berlin has implemented strict regulations regarding short-term rentals to prevent the city from becoming solely a holiday rental/Airbnb hub. 

Per these regulations, secondary residences are limited to a maximum rental period of 90 days per year. A primary residence has no rental period limit, however you must receive permission from the district office.

The district office would decide if the rental is in the best interest of the city. If the private interest outweighs the public interest of preserving the living space then a permit can be granted. 


Registration number for Airbnb properties in Berlin

All types of rentals you now require a registration number. Which can be applied for at the district office. This must always be displayed on listings, especially on online portals like Airbnb. 

When renting out part of your house (under 49% to be exact) a permit is not required. Simply inform the district office so that they can provide you with a registration number free of charge.

There are several other important points to consider regarding short-term rentals in Berlin

  1. Berlin imposes a city tax on tourists, but landlords who rent to workers for professional business reasons (must be for a minimum of two months) are exempt from this tax. Berlin is taking measures to address the rising rental prices that is thought to be caused by Airbnb - by implementing a requirement for Airbnb hosts to display their unique registration number alongside their listing. The registration number is provided to you when you receive your permit. This measure aims to enable local authorities to identify and address any unfair rental offers.

  3. When you rent out a property, you are required to pay tax on the profit earned after deducting allowable expenses. If your short-term rental income is below 520 euros, it is exempt from income tax when the rental is temporary or sublet. However, if this threshold is exceeded, tax is due on the entire amount.
